PLEASE NOTE THAT DISPUTES ABOUT THESE SMS TERMS AND CONDITIONS AND CATERINGREWARDS TEXT MESSAGES (AS DEFINED BELOW) ARE SUBJECT TO BINDING ARBITRATION AND A WAIVER OF CLASS ACTION RIGHTS, AS DETAILED IN SECTION 18 OF THE CATERINGREWARDS TERMS OF USE.References to “these Terms”in Section 18 of our Terms of Use include these SMS Terms and Conditions.

HAR LLC (“CateringRewards,” “we,” “us,” or “our”) provides these SMS Terms and Conditions (the SMS Terms), which govern the provision and delivery of text messages by us or our text message service providers to you (the CateringRewards Text Messages).

E-SIGN Disclosure

By agreeing to receive CateringRewards Text Messages, you consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by emailing CateringRewards at support@CateringRewards.com with "Revoke Electronic Consent"in the subject line.

To view and retain a copy of this disclosure or any information regarding your enrollment in this program, you will need (i) a device (such as a computer or mobile phone) with a web browser and Internet access and (ii) either a printer or storage space on such device. For a free paper copy, or to update our records of your contact information, email CateringRewards at support@CateringRewards.com with contact information and the address for delivery.

Consenting to Receipt of CateringRewards Text Messages

You may provide us with consent to send you CateringRewards Text Messages through our website or an email from us (e.g. by providing us with your phone number during or after enrollment), by initiating a text message to an CateringRewards phone number or SMS short code number (e.g., by texting “JOIN” to an CateringRewards SMS short code), or through other communications with us (e.g. by initiating or agreeing to receive text message communications with customer service). By providing your consent, you agree to these SMS Terms, CateringRewards’s Terms of Use, and CateringRewards’s Privacy Policy.

By consenting to receive CateringRewards Text Messages, you agree that CateringRewards or its service providers may use any automated or non-automated technology to send you CateringRewards Text Messages to the cell phone number associated with your consent. This may be the number you provided or used when you consented to receive CateringRewards Text Messages, or the number we have on file for your account. The CateringRewards Text Messages you receive may be informational or transactional, or they may include promotional or personalized marketing content.

Text messages operated through our long code are informational and transactional messages. For example, you may receive CateringRewards Text Messages from us or our service providers that: (1) provide you with information you requested from us; (2) update you regarding your redemptions, rewards status, and other transactions with us; and/or (3) respond to your customer service requests and other inquiries regarding your use of our services.

Text messages operated through our long code may also have marketing or promotional content. For example, you may receive CateringRewards Text Messages from us or our service providers that include bonus, specials, or other offers.

Costs of CateringRewards Text Messages

CateringRewards does not charge you for our text message program. But message and data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.

We may send you an initial message confirming your enrollment in the CateringRewards Text Messages program. After that, you will receive recurring text messages, and the specific amount may vary depending on a number of factors including how you use our services (e.g. the number of orders placed or received) and whether you take steps to generate additional text messages from us (such as by sending a HELP request).

Participating Carriers

Content is not available on all carriers and carrier participation could change

The content is not compatible with all cell phone models. Please note, however, that the supporting mobile carriers may change without notice. CateringRewards and the mobile carriers (for example, T-Mobile) are not liable for delayed or undelivered messages

Eligibility

By consenting to receive CateringRewards Text Messages, you represent that you are 18 years of age or older and understand the obligations and agree to the terms set forth in these SMS Terms and the CateringRewards Terms of Use, which both form binding agreements between you and us. You further represent that you are the subscriber of the cellular service at the mobile number provided or that you are authorized by the subscriber to sign-up for texts.

Opting Out of CateringRewards Text Messages

For informational,transactional and marketing text messages you can opt out by texting (replying) STOP to our long code. For text messages sent from a different phone number, text STOP to that number to opt out. After doing so, we may send you confirmation of your opt-out via text message. If you have revoked consent and want to re-enroll in our text message program, you can re-enroll by texting START to the applicable number or otherwise enrolling through our website or through communications with us.

Modifications to these SMS Terms

We reserve the right to modify these SMS Terms, or any part thereof, or add or remove terms at any time, and such modifications, additions or deletions will be effective immediately upon posting. Your continued enrollment in CateringRewards’s text messaging program shall be deemed to constitute acceptance by you of such modifications, additions or deletions.
